SERIOUS PENALTIES FOR NON-COMPLIANCE

Wage parity is a legally required supplemental pay benefit for hourly home care aides working for Licensed Home Care Services Agencies (LHCSAs) and other entities in NYC, Nassau, Suffolk, or Westchester.  Wage parity benefits may include New York Labor Law wage deductions or Employee Retirement Income Security Act (ERISA) benefits.  These benefits need to meet multiple levels of government regulations.

Under the Wage Parity Act (WPA), which is enforced by the NYS Departments of Health and Labor, as well as the State Attorney General’s Office, the penalties for non-compliance with the WPA and ERISA are severe, including:
